Terms of use

These terms govern your use of garagequipments.com and every order you place with Garage Equipment, a brand of Autokato Engineering Ltd. Read them before you buy. They cover pricing, payment, freight delivery, returns, warranty, financing and the limits of our liability.

Agreement between you and us. These Terms of Use ("Terms") are a legal agreement between you ("you", "customer") and Garage Equipment, a brand of Autokato Engineering Ltd ("Garage Equipment", "we", "us", "our"), 3261 Philips Hwy, Jacksonville, FL 32207. They apply to the website garagequipments.com (the "Site"), to orders placed online, by phone or by email, and to all related services. Our Privacy Policy, Refund Policy, Shipping Policy and Returns & Warranty pages are incorporated into these Terms by reference.
1. Acceptance of terms

By accessing the Site, creating an account, requesting a quote or placing an order, you confirm that you have read, understood and agree to be bound by these Terms and by the policies incorporated into them. If you do not agree, do not use the Site or place an order.

You must be at least 18 years old and able to enter into a binding contract to buy from us. If you order on behalf of a business, you confirm that you are authorized to bind that business to these Terms. Our equipment is sold for delivery within the 48 contiguous United States only; we do not accept orders for delivery to Alaska, Hawaii, U.S. territories or outside the United States.

We may refuse service, cancel orders or close accounts at our discretion, including where we suspect fraud, resale in breach of a dealer agreement, or misuse of the Site. Any refund owed in those cases is issued in full to the original payment method.

2. Products and pricing

We sell car lifts, mini excavators, mini skid steers, compact tractors, zero turn mowers, lawn tractors, utility vehicles, combo packages, attachments and related shop equipment from brands including Typhon, Atlas, BendPak, Triumph, Tuxedo, Ideal and Alpha Mach.

Descriptions and specifications

We work to keep product descriptions, specifications, images, weights and capacities accurate, but manufacturers change models, engines and features without notice. Images may show optional attachments or colors. Where a specification matters to your purchase (lift capacity, ceiling height, dig depth, engine model, EPA/CARB certification), confirm it with us before ordering. If a product you receive differs materially from its description, you may return it under Section 5 at no cost to you.

Pricing

All prices are in U.S. dollars. The price charged is the price shown at the time your order is accepted. Prices may change without notice, but changes do not affect orders already confirmed. Prices exclude sales tax, which is added at checkout where we are required to collect it. Tax-exempt businesses must provide a valid exemption certificate before the order ships. Freight is free to the 48 contiguous states on every order; Express Freight is an optional $480 flat fee. Coupon codes must be entered at checkout, cannot be combined unless stated, and are not applied retroactively.

Errors

If a product is listed at an obviously incorrect price or with incorrect information because of a typographical, data-entry or system error, we may cancel the order even after confirmation and refund any amount paid. We will tell you before doing so and offer the correct price.

Availability

Stock is shown per warehouse and updates regularly but is not guaranteed. If an item becomes unavailable after you order, we will offer a comparable unit, a back-order date or a full refund.

3. Orders and payment

An order is an offer by you to buy. Our order confirmation email acknowledges receipt; the contract is formed when we accept the order by dispatching the equipment or by written confirmation that it is reserved for you. We may decline any order before acceptance.

Payment methods

We accept major credit and debit cards, PayPal, bank wire transfer, ACH and approved financing (Section 6). Business and fleet customers may pay by purchase order after credit approval. Payment in full, or lender funding, is required before dispatch. Card payments are processed by a PCI DSS compliant provider; we do not store full card numbers.

Verification

For your protection we may verify billing and delivery details, request identification, or require that large orders ship to the billing address. Orders that fail verification are cancelled and refunded.

Changes and cancellations

You may change or cancel an order free of charge within 24 hours of placing it, or at any time before it is dispatched, by calling (904) 214-3064 or emailing info@garagequipments.com. Once the carrier has picked up the shipment, a cancellation is treated as a return under our Refund Policy and return freight applies. Custom-configured and special-order items cannot be cancelled once ordered from the manufacturer.

Chargebacks

Contact us before disputing a charge. Most issues are resolved in one business day. Chargebacks filed on delivered, non-defective equipment in breach of these Terms may be contested and may result in suspension of your account.

Transit times are estimates measured in business days from dispatch, not from the order date, and are not guaranteed. Delays caused by carriers, weather, road closures, strikes or events outside our control do not entitle you to cancel or to compensation, although we will refund the Express Freight fee if an Express shipment misses its window for reasons within our or the carrier's control.

Your responsibilities at delivery. You (or an adult you authorize) must be present at the scheduled appointment, provide a location accessible to a 53-foot tractor-trailer or arrange an alternative with the carrier, and inspect the shipment before signing. Note any damage, shortage or crate breach on the delivery receipt. Signing a clean receipt is your confirmation that the shipment arrived complete and in good condition; concealed damage must be reported to us with photos within 24 hours of delivery. Missed appointments, refused deliveries without cause and redelivery requests are billed at the carrier's rate.

Title and risk of loss. Title to the equipment passes to you when the carrier delivers it. Because we ship on our own freight account, we carry the risk of loss in transit and handle carrier claims on your behalf, provided you follow the inspection and reporting steps above.

5. Returns and warranty

Returns

You may return eligible equipment within 15 calendar days of delivery for a refund of the purchase price, provided it is unused, in its original packaging with all parts, and shipped back with a Return Authorization (RA) number issued by us. You pay return freight unless the item was damaged in transit, defective on arrival or not what you ordered, in which case we pay. Refunds go to the original payment method within 5 to 7 business days of inspection. A restocking deduction of up to 20% may apply where packaging or parts are missing. Custom orders, used or fueled equipment, and items marked final sale are not returnable. The full Refund Policy governs.

Limited warranty

Equipment sold by Garage Equipment is covered by a 1-year limited warranty from the date of delivery against defects in materials and workmanship, covering parts and labor as described on our Returns & Warranty page. Extended coverage of 1, 2 or 3 additional years may be purchased at or shortly after the time of order. Claims are made through warranty@garagequipments.com with the model, serial number, proof of purchase and photos or video of the fault.

The warranty does not cover normal wear items (tires, tracks, blades, belts, filters, fluids, batteries, cutting edges, hydraulic hoses after 90 days), damage from misuse, overloading, accidents, improper installation, lack of maintenance, unauthorized modification, use of non-approved attachments, or commercial rental use unless stated. Our remedy under the warranty is, at our option, repair, replacement of the defective part, or a refund of the purchase price; consequential costs such as downtime, lost income or rental of substitute equipment are excluded.

Except for the limited warranty stated above, all equipment is provided "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law. Some states do not allow limits on implied warranties, so this limitation may not apply to you. This warranty gives you specific legal rights and you may have others that vary from state to state.

Safe use

You are responsible for installing, operating and maintaining equipment in accordance with the manufacturer's manual, applicable OSHA, ANSI/ALI, EPA and local requirements, and for ensuring that operators are trained. Car lifts must be installed on concrete that meets the manufacturer's thickness and strength specification and should be inspected annually by a qualified inspector. Our installation guides are general information, not a substitute for the manual or for a professional installer.

6. Financing

Financing is offered through independent third-party lenders and is available for orders of two or more units purchased at full price, subject to the lender's approval. Garage Equipment is not a lender, does not make credit decisions, and does not guarantee approval or any particular rate or term. The lender's credit agreement, not these Terms, governs the loan or lease.

  • Payment estimates shown on the Site are for illustration only and are not an offer of credit.
  • Financed orders dispatch after the lender confirms funding.
  • If a financed order is returned, the refund is paid to the lender, who adjusts or closes your agreement under its own terms; fees charged by the lender are between you and the lender.
  • Financing applications are handled under our Privacy Policy and the lender's privacy policy.

7. Intellectual property

The Site and its content, including the Garage Equipment name and logo, text, product descriptions, photographs, guides, graphics, page layouts, software and the hazard-stripe design, are owned by or licensed to Autokato Engineering Ltd and protected by United States and international copyright, trademark and other laws. Manufacturer names, logos and product images belong to their respective owners and are used to identify the products we sell.

You may view, download and print pages from the Site for your own personal or internal business use in evaluating and using our products. You may not copy, reproduce, republish, scrape, frame, modify, sell or distribute any part of the Site, use our trademarks in any way that suggests endorsement, or use automated tools to extract pricing or catalog data, without our prior written permission.

Reviews and submissions

When you submit a review, photo, question or other content to the Site, you grant Garage Equipment a non-exclusive, royalty-free, perpetual, worldwide license to use, edit, display and distribute it in connection with our business, and you confirm that it is your own, is accurate, and does not infringe anyone else's rights. We may remove content that is false, offensive, off-topic or promotional. We do not pay for reviews and do not publish reviews we know to be fake.

8. Limitation of liability
To the fullest extent permitted by law, Garage Equipment, Autokato Engineering Ltd and their officers, employees, agents, warehouses, carriers and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, revenue, business, use, data or goodwill, downtime, cost of substitute equipment, or personal injury or property damage arising from improper installation, operation or maintenance, arising out of or related to the Site, these Terms or any equipment purchased, whether based in contract, warranty, tort (including negligence), strict liability or any other legal theory, even if advised of the possibility of such damages.
Our total liability to you for all claims arising from a given order shall not exceed the amount you paid for that order. Our total liability for claims arising from use of the Site not related to an order shall not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our own negligence, fraud, or rights you have under mandatory consumer protection statutes. Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of this section may not apply to you.

The Site is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free or free of viruses, or that stock levels, delivery estimates or the payment estimator will be accurate at all times. Links to third-party sites (carriers, lenders, manufacturers) are provided for convenience; we are not responsible for their content or practices.

9. Indemnification

You agree to defend, indemnify and hold harmless Garage Equipment, Autokato Engineering Ltd and their officers, employees, agents and partners from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising out of or related to:

  1. your breach of these Terms or of any policy incorporated into them;
  2. your installation, operation, maintenance, modification or resale of equipment purchased from us, including any injury to persons or damage to property that results from use contrary to the manufacturer's manual or applicable safety standards;
  3. your violation of any law, regulation or third-party right, including intellectual property and privacy rights;
  4. content you submit to the Site; or
  5. any misrepresentation you make to us, to a carrier or to a lender in connection with an order.

We will notify you promptly of any such claim and may, at our own expense, take over its defense. You may not settle a claim that imposes obligations on us without our written consent.

10. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them, the Site or any order, are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You agree that the state and federal courts located in Duval County, Florida have exclusive jurisdiction over any such dispute, and you submit to the personal jurisdiction of those courts and waive any objection based on inconvenient forum. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

Informal resolution first

Before filing a claim, you agree to contact us at info@garagequipments.com with a description of the problem and the outcome you want, and to give us 30 days to resolve it. Most disputes about delivery, returns and warranty are settled within that period.

Class action waiver and time limit

To the extent permitted by law, claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action, and any claim arising from an order must be filed within one year after the cause of action arises or it is permanently barred.

General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, with the incorporated policies and your order confirmation, are the entire agreement between you and us for your purchase and replace any prior discussions. You may not assign your rights under these Terms without our consent; we may assign ours to a successor of the Garage Equipment business. Notices to us must be sent by email to info@garagequipments.com or by mail to the address in Section 12; notices to you are sent to the email address on your order.

11. Changes to these terms

We may revise these Terms from time to time to reflect changes in our products, services, policies or the law. The "Last updated" date at the top of the page identifies the current version. Orders are governed by the version in force when the order was placed; we will not apply changes that reduce your rights to an existing order. For other changes, continued use of the Site after the revised Terms are posted means you accept them. We recommend reviewing this page before each purchase. Previous versions are available on request.
